By downloading and using Air Drum, you agree to these terms.
1. Acceptance of Terms
By downloading, installing, or using Air Drum ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.
2. License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on devices that you own or control.
2.1 Restrictions
You may not:
- Copy, modify, or create derivative works of the App
- Reverse engineer, decompile, or disassemble the App
- Rent, lease, lend, sell, or redistribute the App
- Remove any copyright or proprietary notices from the App
3. User-Generated Content
3.1 Your Content
The App allows you to create recordings and videos ("User Content"). You retain all ownership rights to your User Content. All User Content is stored locally on your device, and we do not have access to or control over your User Content.
3.2 Responsibility
You are solely responsible for your User Content and the consequences of creating or sharing it. You agree not to create or share content that:
- Violates any third-party rights, including intellectual property rights
- Is unlawful, harmful, threatening, abusive, or otherwise objectionable
- Contains viruses or malicious code
4. Paid App
Air Drum is a paid application available for purchase through the Apple App Store. All purchases are processed by Apple and are subject to Apple's terms and policies.
4.1 Refunds
Refund requests must be made through Apple. We do not process refunds directly. Please refer to Apple's refund policy.
4.2 No Subscriptions
The App is sold as a one-time purchase. There are no recurring subscriptions or in-app purchases at this time.
5. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR OTHER INTANGIBLE LOSSES.
7. Device Requirements
The App requires an iPhone with motion sensors (accelerometer and gyroscope). Performance may vary depending on your device model and iOS version. We recommend keeping your device and the App updated to the latest versions.
8. Changes to the App
We reserve the right to modify, suspend, or discontinue the App at any time without notice. We may also update the App to add new features, fix bugs, or improve performance.
9. Changes to These Terms
We may update these Terms from time to time. We will notify you of any material changes through the App or App Store update notes. Your continued use of the App after changes constitutes acceptance of the updated Terms.
10. Termination
These Terms are effective until terminated. Your rights under these Terms will terminate automatically if you fail to comply with any of its provisions. Upon termination, you must cease all use of the App and delete it from your devices.
11. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
